En cumplimiento con el Artículo 5 de la NOM 247 En caso de una oferta aceptada, y si se solicita un Período de Diligencia por parte del Cliente, este último tendrá derecho a solicitar a Villa Lux Properties, SAPI de CV, operando como Azimuth Luxury Real Estate, la información contenida en esa misma sección, incluyendo entre otros – (i) Información de creación de la Compañía Villa Lux Properties, SAPI de CV, (ii) Información de Contacto, (iii) Dirección, teléfono y correo electrónico, (iv) carta confirmando el derecho a listar la propiedad y/o el derecho de contactar al Corredor de listado para comercializar la Propiedad, así como (v) como título de la Propiedad, (vi) información de cualquier gravamen si corresponde, (vii) condiciones de financiamiento si están disponibles (viii) Permisos de construcción, manifestación y otros documentos relevantes, incluyendo si está disponible por el vendedor de planos, y otras especificaciones, incluido cualquier tipo de garantía, si está disponible.

Además, ningún material de marketing pretende inducir al comprador a error o equivocación en las condiciones extraordinarias de la propiedad. Por lo tanto, los clientes tienen derecho a confirmar toda la información durante una visita a la propiedad.

NO DISCRIMINACION

Como proveedor de servicios AZIMUTH LUXURY REAL ESTAE (VILLA LUX PROPERTIES, S.A.P.I. DE C.V.), reconoce no ejercer preferencia o discriminación alguna a prospectos consumidores tales como selección de clientela sin consideración de raza, estado familiar, origen de nacionalidad, condicionamiento, reserva del derecho de admisión, exclusión a personas con discapacidad o cualquier otro factor contenido en la ley federal, estatal o local, a excepción de causas que servicios AZIMUTH LUXURY REAL ESTAE (VILLA LUX PROPERTIES, S.A.P.I. DE C.V.) considere puedan afectar la seguridad o tranquilidad del establecimiento, de sus clientes o se funden en disposiciones expresas de ordenamientos legales.

In compliance with Section 5 of NOM 247, in case of an accepted offer, and if a Due Diligence Period is requested by the Client, the latter will have the right to request to Villa Lux Properties, SAPI de CV, doing business as Azimuth Luxury Real Estate, the information contained in that same section including among others – (i) Information of Company creation  of Villa Lux Properties, SAPI de CV, (ii) Contact Information, (iii) Address, phone and email, (iv) letter confirming the right to list the property and or the right to contact the listing Broker to market the Property, (v) Property title, (vi) information of any liens if any, (vii) financing conditions if available (viii) Construction permits, manifestation and other relevant documents including Plans if available, and other specifications including any type of warranty if available.

In addition, all marketing materials are not intended to induce a Purchaser to an error or mistake in extraordinary Conditions of the Property. Therefore, the Clients have the right to confirm all information in a visit to the Property.

The contracts to be used to enter into a valid  offer are or will be registered at the Mexican Consumer Agency (Procuraduria Federal del Consumidor) PROFECO.  The Contracts  Registration Number will be provided to Client upon request. As a service provider, AZIMUTH LUXURY REAL ESTATE (VILLA LUX PROPERTIES, S.A.P.I. DE C.V.) acknowledges that it does not exercise any preference or discrimination against prospective consumers, such as selecting clients without regard to race, familial status, national origin, conditioning, reservation of the right of admission, exclusion of persons with disabilities, or any other factor contained in federal, state, or local law, except for reasons that AZIMUTH LUXURY REAL ESTATE (VILLA LUX PROPERTIES, S.A.P.I. DE C.V.) considers may affect the safety or peace of the establishment or its clients, or are based on express provisions of legal regulations.

CONSUMER RIGHTS LETTER

In terms of the NOM-247-SE-2021of the Federal Consumer Protection Law (PROFECO), in all commercial transactions for the residential purchase and sale, VILLA LUX PROPERTIES, S.A.P.I. DE C.V. commercially known as AZIMUTH LUXURY REAL ESTATE, undertakes to ensure that they are carried out in accordance with the provisions of the LFPC, its Regulations and this NOM, and therefore recognizes that consumers have the following rights:

1. To receive, with respect to the real estate offered, truthful, clear and updated information and advertising, regardless of the means by which it is communicated, including digital media, in such a way that allows the consumer to make the best purchase decision knowing truthfully the characteristics of the property he/she is acquiring, in accordance with the provisions of the Law.


2. To know the information about the characteristics of the property, among these: the extension of the land, built surface, type of structure, installations, finishes, accessories, parking place, common use areas, services and general physical condition of the property.

3. Freely choose the property that best meets your needs and fits your purchasing power.

4. Not making any payment until the contractual relationship is recorded in writing, except for advance payments and operating expenses, in accordance with the terms set forth in the LFPC.

5. Sign an adhesion contract under the model registered with the PROFECO, in which the terms and conditions of the sale and purchase of the real estate are stated. After signing the contract, the supplier is obliged to deliver a copy of the signed contract to the consumer.

6. Acquire a property that has the safety and quality characteristics contained in the applicable regulations and reflected in the information and advertising that the consumer has received.

7. To receive the real estate in the term and conditions agreed with the supplier in the respective adhesion contract.

8. If applicable, exercise the real estate guarantees provided for in the LFPC, considering the specifications set forth in the respective adhesion contract.

9. Receive the corresponding bonus or compensation in terms of the LFPC, in the event that once the guarantee has been exercised, defects or faults persist in the property. Likewise, to have the necessary repairs made in the event of defects or faults attributable to the supplier, or to opt for the replacement of the property or termination of the contract when applicable.

10. To have free and accessible channels and mechanisms of attention for consultations, requests, claims and suggestions to the supplier, and to know the address indicated by the supplier to hear and receive notifications.

11. Right to protection by the competent authorities and in accordance with applicable laws, including the right to file complaints and claims before them.

12. Have at your disposal a Privacy Notice to know the treatment that will be given to the personal data you provide and consent, if applicable; that your personal data will be treated in accordance with the applicable regulations and know the mechanisms available to exercise your Rights of Access, Rectification, Cancellation and Opposition (informally known as Derechos ARCO).
13. Receive a treatment free of discrimination, without being denied or conditioned the attention or sale of a home for reasons of gender, nationality, ethnicity, sexual preference, religion or any other particularity under the terms of applicable law.

14. Freely choose the notary public to carry out the deed process.
